Farmers Club Terms & Conditions

Club Glossary of Terms

  • ‘Anniversary’ means 12 months from an individual Member’s join date.
  • ‘Beauty’ means all cosmetics, skincare, haircare and fragrance (including some home fragrance).
  • 'Birthday Gift' means a free mystery gift available for Members to redeem for their birthday, which is chosen by Farmers, and may vary from store to store.
  • ‘Card’ means the Farmers Club Loyalty Card.
  • 'Farmers' refers to The Farmers Trading Company Limited. Customers can find Farmers contact information online at www.farmers.co.nz ('website') or reach us by telephone on 0800 327 637.
  • ‘Farmers Club’ means the Farmers Club loyalty programme.
  • ‘Fashion’ means Women’s Clothing, Lingerie and Accessories and Men’s and Children’s Clothing, Underwear and Accessories.
  • ‘Home’ means Toys, Nursery, Furniture, Electronics and Appliances, Homeware, Manchester and Stevens.
  • 'Member' means a person with an individual Farmers Club account.
  • ‘Membership’ means an individual Farmers Club account.
  • ‘Member Terms and Conditions’ means these Terms and Conditions for Farmers Club Membership.
  • ’Points’ means tokens collected through shopping with Farmers and Stevens.
  • ‘Promotions’ means any offers, promotions or benefits, including discount or points-based events in store or online, and competitions.
  • ‘Technical Issues’ means the technical malfunction of any telephone network, connection or lines, computer online systems, servers or providers, computer equipment, software, technical problems or traffic congestion on the internet or at any website or intranet site.
  • ‘Voucher’ means a $20 Club voucher, held electronically on your Membership, which is earned through the accumulation of Points.
  • ‘Website’ means www.farmers.co.nz.

1. General

  1. The Member Terms and Conditions document the operation of the Farmers Club, the use of Membership, any promotional activity and member transactions that arise as a consequence of the Farmers Club.
  2. If you join the Farmers Club, you agree to be bound by these Member Terms and Conditions.
  3. Farmers will provide reasonable notice to Members of any change to the Member Terms and Conditions that will reduce the rate at which Points are collected, increase the number of Points required to earn a Voucher, or reduce the value of a Voucher. Outside of those circumstances, the Member Terms and Conditions may be modified by Farmers from time to time without prior notification. It is recommended that you check these Terms and Conditions periodically. The continued use of your Farmers Club Membership after the effective date of change will constitute your acceptance of the revised Terms and Conditions. If you do not agree to changes, you may cancel your account by contacting us.
  4. Farmers will not accept any liability for any email that is misdirected, lost or not received.
  5. Farmers (including its officers, employees and agents) excludes all liability to the fullest extent permitted by law for loss or damage (other than where the loss or damage is due to Farmers' negligence or wilful default); whether direct, indirect, special or consequential, arising in any way out of Farmers Club or any Membership, including but not limited to: (a) any technical difficulties, network failures, virus or equipment malfunction; (b) any loss, theft, unauthorised access or third party interference with Points, Vouchers, Membership information or the Card; (c) any Points or Vouchers that are not properly recorded against a Member's Card; (d) participation in, or termination of Farmers Club; (e) Force Majeure.
  6. Farmers may collect personal information from you for the purpose of facilitating the operation of the Farmers Club. By becoming a member of Farmers Club, you agree to the terms of our Privacy Policy and in particular to the collection, use and disclosure by Farmers of your personal information as described in that Policy.
  7. Farmers reserves the right to cancel, terminate, modify or suspend the Farmers Club membership at any time and without notice for: fraudulent use of the Card, unlawful or improper conduct, abuse of the Farmers Club membership, non-compliance with these Terms and Conditions or on other reasonable grounds. In the event that your Membership is revoked, all accrued Points and Vouchers will expire from the date of revocation and you will have no further entitlement in respect of Farmers Club.
  8. Farmers Club memberships will be marked for closure after 3 years of inactivity.
    To keep your membership active:
    - Log in to your Farmers Club account online. This will extend your account's activity for another 12 months.
    - Alternatively, swipe your Farmers Club card when making a purchase in-store. This will extend your account’s activity for another 3 years.
    Ensure you perform one of these actions before the 3-year inactivity period to avoid membership closure.
  9. Farmers may, at any time, require you to provide the proof of identification (in a form requested by Farmers) for Farmers to verify the authenticity of your membership and compliance with the Terms and Conditions. Failure to provide proof of identification may result in termination of your involvement in the Farmers Club.
  10. Farmers will not be liable for any tax liability incurred by you in connection with the Farmers Club, including that incurred in the provision and/or utilisation of rewards.
  11. These Members Terms and Conditions are to be read in conjunction with any additional conditions associated with Farmers Club rewards, including, without limitation, the Website terms and conditions and other relevant Farmers policies and/or terms and conditions.
  12. Any failure or delay by Farmers in exercising its rights under these Terms and Conditions does not constitute a waiver of those rights. Any waiver by Farmers must be in writing and signed by an authorised officer of Farmers.
  13. From time to time, Farmers may provide Members with Promotions in connection with the Card. These Terms and Conditions shall apply to such Promotions, in addition to any specific Terms and Conditions accompanying such Promotions. In the event of any inconsistency, the specific Terms and Conditions of the Promotion shall apply.

2. Joining Farmers Club

  1. To be a Farmers Club member you need to be aged 16 or older.
  2. Applications for Membership may be completed in store at Farmers or Stevens or on the Farmers Website. Failure to provide any information designated as mandatory will mean you will be ineligible for Membership. All information provided must be true and correct. It is your responsibility to keep your details up to date at all times by making changes through the Website, or by advising a staff member in store.
  3. Memberships without an associated valid email address will not be eligible for the full benefits and rewards of Farmers Club. It is your responsibility to keep the recorded email address current. Where an email address is provided it will be used to email you when you reach a Voucher, when you have Vouchers expiring, when you are eligible for a Birthday Gift and with any Farmers Club news or updates.
  4. If you unsubscribe from marketing messages, you'll still receive emails from us about Farmers’ orders, when you earn a Voucher and when you have Vouchers expiring, Farmers Club updates or other information about your Farmers’ Club membership.
  5. Applications for Membership may be made by any individual. If you are residing overseas you will not receive a physical Card. It is not possible to redeem Vouchers online at Farmers or Stevens. As a result, overseas members will only be able to do so when shopping in physical Farmers and Stevens stores in New Zealand. Only one membership is permitted per individual. Farmers reserves the right to accept or reject any application for Membership and shall not be required to provide any reason for such acceptance or rejection.
  6. When you apply for Membership online, or when you access your account online, you will be required to create a secure password to access your account via the Website. You agree not to disclose your password to any other person.
  7. You should present your Card in store at Farmers or Stevens or sign-in to the Website when shopping online at Farmers for all purchases of products and services. This is to enable Farmers to provide you with the full benefits of the Farmers Club.

3. Collecting Points

  1. When you purchase products or services from a Farmers and Stevens store, instore or online, and the spend value equals or exceeds the minimum spend-to-point qualifier for those products or services, you will collect Points based on the amount spent. You will receive a Voucher for every 250 Points you collect.
  2. The amount of spend required per Point and the products and services on which Points can be earned may vary from time to time. You should refer to the Website or check with a staff member for an up-to-date list of qualifying products / services and the level of spend required per point.
  3. For Farmers purchases, in store or online, points are awarded/allocated as follows:
    1. Collect 1 Point for every $1 you spend on all Beauty and Fragrance (including: The Aromatherapy Co., Circa Home, ECOYA, Glasshouse, Jo Malone London, Peppermint Grove).
    2. Collect 1 Point for every $5 you spend on all Women’s Clothing, Lingerie & Accessories and Men’s and Children’s Clothing, Underwear & Accessories.
    3. Collect 1 Point for every $10 you spend on Toys, Nursery and everything for your home including Furniture, Electronics and Appliances, Homeware and Manchester, Home Fusion, Salt & Pepper.
  4. For Stevens purchases instore and online, you collect 1 Point for every $10 you spend.
  5. You may still collect Points in store if you do not have your Card with you by quoting the phone number associated with your Farmers Club account or, when shopping online, by signing into the Farmers Club online before the transaction is completed.
  6. Points do not have any value and cannot be redeemed for cash, gift cards or any Farmers or Stevens products and services except as expressly set out in these Terms and Conditions.
  7. Points collected in Beauty and Fashion expire 6 months from the date of purchase of eligible items (collection). Points collected in Home expire 12 months from the date of purchase of eligible items. Points will expire unless 250 points are collected and converted to a Voucher.
  8. If you return a product in accordance with the Farmers and Stevens returns policy, or cancel an order for a product on which you have earned Points, the Points will be deducted from your Points balance.
  9. Points cannot be sold and cannot be transferred to another person, unless expressly permitted by Farmers or Stevens.

4. Vouchers

  1. Vouchers are only credited to your membership in denominations of $20 and can only be redeemed in full $20 increments.
  2. Vouchers cannot be sold and cannot be transferred to another person, unless expressly permitted by Farmers or Stevens.
  3. When a Voucher is redeemed, Points will not be earned on the value of the Vouchers redeemed. To redeem your Voucher, you must:
    1. Comply with the specific requirement(s) of the Voucher(s) as notified on, or in relation to the Voucher itself.
    2. Purchase Farmers or Stevens products or services in a category in which your Vouchers may be redeemed in a single transaction, the purchase price of which is greater than, or equal to, the value of the Voucher(s) you are redeeming. Where the purchase price in a single transaction is less than the value of a Voucher you wish to redeem you will be unable to redeem your Voucher.
  4. The categories in which Voucher(s) may be redeemed may vary from time to time. You should refer to the Website for an up-to-date list of categories in which you can redeem Voucher(s).
  5. To the extent that the purchase price exceeds the value of a Voucher(s) on your Card, you must pay the difference.
  6. Voucher(s) cannot be exchanged for cash or gift cards.
  7. Voucher(s) can only be redeemed at Farmers stores, online at farmers.co.nz or Stevens stores.
  8. You can redeem Vouchers by presenting your Card at a Farmers or Stevens stores or by signing in to your account online at farmers.co.nz. Your Card may only be used for transactions made by you personally. Farmers and Stevens reserves the right to require identification when redeeming Vouchers.
  9. Vouchers are valid for 3 months from date of being earned and will expire after 3 months if not used.
  10. If a return is initiated while you have a voucher balance, the refunded amount will be deducted from your points balance, not the voucher balance.

5. Birthday Gift Benefit

  1. To qualify for a Birthday Gift, Members must provide us with a valid email address and have marketing email permissions switched on in the My Preferences page.
  2. The Birthday Gift email and the Member’s Card must be presented at the point of gift collection.
  3. The Birthday Gift can only be redeemed at Farmers' physical stores in the month of the Member's birthday, or any longer period permitted by Farmers in its sole discretion. Excludes online and Stevens stores.

6. Monthly Points Party

  1. All qualifying members (as defined in paragraph 47.) are automatically entered into a Monthly Points Party.
  2. There are 3 monthly prizes of 1000 points to be won.
  3. 3 qualifying members will randomly be selected each month.
  4. Winners will be notified through both contact number and email. Once the prize is accepted, points will then be loaded onto the winner’s Card.
  5. Qualifying members are Farmers Club Members who are receiving marketing email from Farmers. Check you have provided a valid email address and have marketing email permissions switched on in the My Preferences page.
  6. Farmers employees are not eligible to enter the Monthly Points Party draw.

7. Farmers Club Membership Card

  1. The Card is not a debit or a credit card. All Cards remain the property of Farmers at all times and must be surrendered on demand.
  2. In the event that your Card is lost, stolen or damaged, you will need to request a new Card either in store at Farmers or Stevens or on the Farmers Website. You must advise the Farmers contact centre or in store staff as soon as you are aware your Card is lost, stolen or damaged. Farmers do not accept any responsibility for lost, stolen or damaged Cards, or any resulting loss or theft of Points or Vouchers.

We reserve the right to amend these terms and conditions at any time, we therefore recommend that you review these terms and conditions each time you visit the website.

These terms and conditions are governed by and will be construed in accordance with the laws of New Zealand and you submit to the non-exclusive jurisdiction of the Courts of New Zealand. If at any time we do not enforce any of these terms and conditions or grant you time or other indulgence, we will not be construed as having waived that term or condition or our rights to later enforce that or any other term or condition. The design and content contained within our website is intellectual property which is either owned or licenced by Farmers. The website is intended solely for your personal non-commercial use. Any use of our website and its content for purposes other than personal non-commercial use is prohibited without our prior written permission.

You may not systematically extract and/or utilise parts of the content of our website and in particular, you may not utilise any data mining, robots or similar data gathering and extraction tools to extract (either once or many times) without our prior written permission. You may not create and/or publish your own database that features content on this website (e.g. our prices and product listings) without our prior written permission.

Each of the various trademarks, product names, company names and corporate identities represented on our website are the property of the individual companies, used by us with their permission, and are not to be reproduced or used without the express permission of its owner.

Website Use

When you place an order on our website, you are making an offer to buy the goods and/or services. When you place an order you will be required to provide details to enable us to fulfil and deliver the order to you.

Automated Orders, Bots and Scrapers

We strictly prohibit the use of any automated systems, bots, crawlers, scrapers, or similar technologies to access, interact with, or place orders through this website.

Any orders created or attempted using automated means, including bots or scripts designed to bypass our checkout process, will be cancelled without notice. We reserve the right to block or restrict access to our website for any users or IP addresses suspected of using such technologies.

All legitimate customer orders must be placed manually through the website by a natural person using a standard web browser. Any attempt to manipulate pricing, availability, or transaction processes using automation constitutes a breach of these Terms and Conditions.

Product Information

We have made every effort to display the products featured as accurately as possible. The equipment you use to view our website may impact on the display of our products. We do not guarantee that the colour, texture or detail of the product shown on your screen will accurately reflect the actual product.

Measurements provided on our website site are approximate only. Age information is supplied as a guide only. Please check the manufacturer's instructions and/or packing to ensure the product is age appropriate.

The website is provided for our customers to buy, or find out more about our products and services. Products displayed may not be available in all physical stores or available to purchase through our website.

Some products may only be purchased from our website and may not be available in any of our physical stores.

We reserve the right to limit quantities or limit the number of products customers can purchase in a single transaction.

Pricing & Promotions

Prices are displayed in New Zealand dollars, inclusive of goods and services tax (GST). We have made every effort to provide accurate pricing information on our website. In the event of a pricing error on our website, the inaccurate price will not be honoured at our physical stores and we reserve the right to cancel any orders placed on our online store.

Farmers reserve the right to change any aspect of our product information at any time without notice.

Promotions: Promotions are available only while stocks last. Discounts are off the regular retail price and not available in conjunction with any other offer. These may replace other offers. You get the better deal! Accessories used in photographs are not included in the price and colours may differ slightly from online images. Promotions exclude gift cards, non-ranged, Superdeals, clearance and Red Dot items. Some items may not be held in store at Farmers and may require a waiting period for delivery. Not all products shown in promotional catalogues may be purchased online or in store.

Farmers Club Exclusive Promotions: In addition to the “Promotions” terms and conditions, Exclusive Farmers Club online offers are only available when you join or sign in to Farmers Club. Promotional pricing appears only when signed in to Farmers Club and after the product is added to the cart.

Clearance (including Red Dot Clearance): Clearance offers are available only while stocks last. Stock is strictly limited, first in, first served. Pricing reflects the clearance price (prices as marked), no other discount applies. Clearance offers are excluded from any other promotion.

Stock Availability

Products displayed on our website are subject to availability in our physical and online store. We have made every effort to provide accurate stock availability information on our website, however, we do not guarantee that if a product is classified as being “in stock” that stock will be available to purchase at our physical stores or online.

Terms of Sale

In addition to the above General Website Terms and Conditions, the following terms and conditions of sale apply to all purchases by you through our website. By completing a purchase order you are stating that you agree to be bound by all of these terms and conditions.

Acceptance of Orders: Dispatch of orders is subject to stock availability and you will be advised if a product is unavailable. To the maximum extent permitted by law, we will not be liable to any person if we decline to fulfil, or are unable to fulfil, an order.

Prices: We will charge you the retail price shown on the website at the time you submit your order. You may also be charged additional delivery fees.

Payment: You may pay online by MasterCard, Visa, Amex, QCard, Farmers Finance Card, ASB True Rewards Card, Farmers Club Vouchers and by Farmers Gift Cards. Unfortunately, we are unable to accept Farmers Gift cards from Gift Station online.

Farmers Gift Card Terms and Conditions

For Farmers Gift Cards purchased from Farmers stores or the Farmers website: This Gift Card has no value until activated at time of purchase. This Gift Card is issued by the Farmers Trading Company Limited. This Gift Card can be used for the purchase of goods and services at any Farmers store, including www.farmers.co.nz, and Stevens store, including www.stevens.co.nz, with the exception of counters operated by third parties. It cannot be returned for cash or used as payment on any Farmers Finance Card, Farmers MasterCard or any Long Term Finance Account. Any unused value on the Gift Card expires 4 years after date of issue. To use, simply present the Gift Card for full or part payment of goods or services at the time of purchase. The amount of any purchase will be deducted from the Gift Card. You may check your current balance and card expiry date at any time by visiting www.farmers.co.nz/gift-cards/check-your-gift-card-balance.
Please note we do not accept Farmers Gift cards purchased via Gift Station online. Farmers gift cards purchased via Gift Station can be redeemed in our physical stores only.

Bonus Gift Card Promotions – Farmers issued

Where a Bonus gift card promotion is advertised, and the gift card is issued by Farmers, the standard Farmers Gift Card Terms and Conditions apply. This includes but is not limited to a 4 year expiry period from date of issue.

For purchases made in-store, a bonus gift card will be issued in-store. For purchases made online at www.farmers.co.nz, the bonus gift card will be an eGift card which will be emailed to the email address on your Farmers online order. If the product you purchased is returned the bonus gift card will be cancelled. If the bonus gift card has been partially or fully used then the amount used will be deducted from the refund value of the product returned.

Bonus Gift Card Promotions – Via redemption from a Farmers supplier or third party

The Terms and Conditions of the promotion can be found on the relevant supplier’s website. Please read the terms and conditions set out by the supplier. Please note the promotion is run by the supplier, and the agreement is between the customer and the supplier in regard to the promotion.

Delivery  

We currently only supply to New Zealand addresses. Please ensure the delivery address and receiver’s name for your order is accurate and complete (including any business name if shipping to a work address) as we may be unable to change these details once the order has been placed. We will not take responsibility for any orders that go missing due to incorrect delivery information provided by you. We will endeavour to deliver goods on the agreed delivery dates but, to the maximum extent permitted by law we will not be held liable for late delivery.

Deliveries are sent with no signature required. If you require signature on delivery please ensure you select this option on the delivery page via checkout. Somone will need to be at the delivery point to sign for the order. 

Delivery to rural addresses or delivery of dangerous goods may take longer in some areas. Delivery will be deemed to have been made when the goods arrive at the delivery point agreed with you, or, if you are to arrange delivery, when the goods are available for collection by you.

You must notify us within 8 days of the dispatch date (as stated in the email we send confirming dispatch) if you have not received an item. Risk in the goods will pass to you on delivery.

Returns

Any return of goods is subject to our Returns Policy.

Order Cancellation  

Once your order is confirmed we are unable to change or cancel any aspects of your order. Please carefully check your order details before completing payment of the order. In order to protect our customers and services, we reserve the right to cancel orders or request other methods of payment for orders received.

Consumer Guarantees Act  

Nothing in these terms and conditions will limit or affect your rights as a consumer under the Consumer Guarantees Act 1993 to the extent that such limitation or other contracting out is prohibited by that Act.

Limitation of Liability 

To the maximum extent permitted by law:

  • we exclude all warranties, descriptions, representations or conditions in relation to the goods and/or services provided by us implied by law, trade, custom or otherwise;
  • where goods are advertised with reference to photograph(s) we will endeavour to deliver the corresponding goods, however, we do not warrant that the goods we deliver to you will be identical to those displayed in the photograph(s);
  • our liability for any claim, damages, loss or expense related to the supply by use of goods or services is limited to the cost paid by you for such good or services;
  • we will not be liable, whether in contract, tort (including negligence) or otherwise for any indirect, consequential or special loss or damage, or loss of profits, loss of data, loss of savings and loss of opportunity.

General

We reserve the right to remove, suspend or make changes to our website at any time, without prior notice.
